It has become common place for the members of the public to use the words without prejudice believing that the words will somehow protect them.
The only time that the words “WITHOUT PREJUDICE” have any meaning is when use them in the correct manner.
The purpose of the words “without prejudice” is specifically used when you are negotiating settlement of a dispute. This is so that the information used while negotiating is not used against a party if the matter lands up in Court .
Even if correspondence is not marked without prejudice but it is clear that the intention is genuinely to try and settle such correspondence or meeting would be without any prejudice to that party’s rights.
On the other hand if you attempt to conceal information by writing without prejudice it will not work unless it is a genuine attempt to settle a dispute
